This Privacy Policy describes how your Personal Information is collected, used, stored, shared, erased and/or destroyed when you visit or make a purchase from tilecityja.com (the “Site”). It also describes the rights which you may have in relation to the Personal Information which is collected, used, stored, shared, erased and/or destroyed by us.

Types of Personal Information which may be  collected

Device Information when you visit the Site, we automatically collect certain information about your device, including but not limited to information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we may collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

Order Information
Additionally when you make a purchase or attempt to make a purchase through the Site, we may collect certain information from you, including but not limited to your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.

We also coll
ect purchased marketing data.

Any reference to  “Personal Information” in this Privacy Policy shall include both  Device Information and Order Information.

How do we use your Personal Information?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we may use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

When in line with the preferences you have shares with us, your Device information may be used for advertising relating to our products or services such as targeting and retargeting purposes.

Sharing your Personal Information
We may share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use WIX to power our online store. We may need to transfer Personal Data to third-parties located in a territory outside of Jamaica for further processing in accordance with the purposes for which the Personal Information was originally collected.

By visiting our Site and/or purchasing a product via the Site you hereby consent to the transfer of your Personal Information to a territory outside of Jamaica whenever such need may arise.

You shall not hold us liable for the manner in which your Personal Information is processed and/or used by any third-parties which are situated outside of Jamaica.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Your rights
You have the right to access Personal Information we hold about you and to ask that your Personal Information be corrected, updated, or deleted.

You have the right to ask us to stop processing your Personal Information in certain circumstances, for example, where the processing is likely to cause substantial damage or distress. You also have the right to object where we are processing your Personal Information for direct marketing purposes. You may opt-out of receiving direct marketing from us at any time.

If we rely on your explicit consent for processing your Personal Information, you may withdraw your consent at any time. However, we note that this will not affect the lawfulness of any processing carried out before you withdraw your consent. Accordingly, if you withdraw your consent, we may deny you access to our services.  We will of course advise you, if this is the case, at the time you withdraw your consent.

We take appropriate technical and organizational measures to keep your Personal Information confidential and secure, in accordance with our internal policies and procedures regarding collection, use, storage of, access to, disclosure, erasure and destruction of Personal Information.

 

All of our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors and data processors (i.e. those who process your Personal Information on our behalf, for the purposes listed above), who have access to, and are associated with the processing of your Personal Information, are obliged to respect the confidentiality of such Personal Information.

We do not warrant nor do we make any representations that your Personal Information may not be accessed, used, disclosed, altered, or destroyed by breach of such safeguards. We will notify you immediately in the event of a security breach affecting your Personal Information and will maintain an incident response policy that includes notifications consistent with applicable law.

 

Correcting and Updating Personal Information

You must inform us immediately where your Personal Information has changed, or where you believe that the Personal Information we hold is inaccurate or incomplete.

We shall not be held responsible for any loss, damage or claim that may arise due to any inaccurate or incomplete Personal Information which you have provided to us.

Links to third-party websites

Our website may, from time to time, contain links to and from the websites of others. The Personal Information that you provide through these websites is not subject to this Privacy Policy and the treatment of your Personal Information by such websites is not our responsibility. 

If you follow a link to any other websites, please note that these websites may have their own privacy policies which will set out how your Personal Information is collected and processed when visiting those sites.

 

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records for a period of seven (7) years unless and until you ask us to delete this information, or such other period as may be reasonably necessary in the circumstances to protect or preserve our rights or comply with our legal or regulatory obligations.

Changes to this Privacy Policy
This Privacy Policy was last updated in December 2022]. We will update this Privacy Policy from time to time to reflect any changes to our use of your Personal Information. We may also update this Privacy Policy as required to comply with changes in applicable law or regulatory requirements. Our obligations will be determined having regards to the policy as amended from time to time and not the policy at the time your Personal Information was collected by us. We will post notifications of any changes to this Privacy Policy on our website and we encourage you to check our website periodically so as to become aware of any changes to this Privacy Policy.

 

Minors
The Site is not intended for individuals under the age of eighteen (18) years.
